Terms of Service (Journeylore)

• "Service" means the services provided by the Service Provider as "Journeylore" and its related services.

• "Site" means the website where the content of the Service is posted.

• "Content" means any and all text, audio, still images, videos, software programs, code, etc. provided on the Service (including posted information).

• "User" means anyone who uses the Service.

• "Registered User" means a person who has completed user registration on the Site.

• "ID" means a unique string of characters possessed by a Registered User for the use of the Service.

• "Password" means a cipher uniquely set by a Registered User corresponding to their ID.

• "Personal Information" means collectively any information that can identify an individual, such as address, name, occupation, telephone number, etc.

• "Registration Information" means collectively the information registered by a Registered User on the Site (excluding posted information).

• "Intellectual Property" means inventions, devices, new plant varieties, designs, copyrightable works, and other things produced by human creative activities (including discovered or deciphered laws or phenomena of nature that have industrially applicable potential), trademarks, trade names, and other items indicating goods or services used in business activities, as well as trade secrets and other technical or business information useful for business activities.

• "Intellectual Property Rights" means patent rights, utility model rights, breeder's rights, design rights, copyrights, trademark rights, and other rights stipulated by law or rights pertaining to legally protected interests regarding Intellectual Property.

• Users may use the Service upon agreeing to these Terms of Service.

• A legally binding agreement under these Terms is formed between the User and the Service Provider at the time the User downloads the Service to a smartphone or other information terminal and completes the procedure to agree to these Terms.

• If the User is a minor, the Service must be used only after obtaining the consent of a person with parental authority or another legal representative.

• If a minor uses the Service by misrepresenting that they have obtained consent from a legal representative when they have not, or by falsifying their age as an adult, or otherwise using fraudulent means to make others believe they are a person with legal capacity, they may not rescind any legal acts related to the Service.

• If a User who was a minor at the time of agreeing to these Terms uses the Service after reaching the age of majority, the User shall be deemed to have ratified all legal acts related to the Service.

• The Service Provider reserves the right to amend these Terms at any time at its sole discretion, and the User shall consent to this without objection.

• When revising these Terms, the Service Provider will notify the User of the contents by a method determined by the Service Provider.

• The effectiveness of any revision to these Terms shall arise from the time the Service Provider gives notice pursuant to the preceding paragraph.

• Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms of Service.

• Users who wish to register for an account (hereinafter referred to as "Applicants") shall apply for membership by a designated method upon agreeing to these Terms.

• An Applicant becomes a Registered User at the time the Service Provider accepts the application and ID registration is completed.

• The Service Provider will provide Registered Users with notices, advertisements, and other information via email. Please be aware of this in advance.

• The Service Provider may refuse a membership application at its sole discretion if an Applicant falls under any of the following items:　 (1) When the Applicant applies for membership by a method other than that prescribed by the Service Provider.　 (2) When the Applicant is a person who has previously had their membership revoked for violating these Terms or other terms of use prescribed by the Service Provider.　 (3) When the Service Provider determines that the Applicant is registering using unauthorized means.　 (4) When the Applicant registers information other than their own.　 (5) When the Service Provider otherwise determines it to be inappropriate.

Paragraph 1

Users shall optionally register and manage information registered upon use (hereinafter referred to as "Registration Information", including email addresses, IDs, passwords, etc.) under their own responsibility. Users shall not allow a third party to use this information, nor shall they lend, transfer, change the name of, or buy/sell it.

Paragraph 2

If the Service is used using the Registration Information, the Service Provider may treat it as having been used by the person who registered for use, and the consequences arising from such use and all related responsibilities shall belong to the person who registered for use.

• Infringing upon the intellectual property rights of the Service Provider or a third party.

• Defaming, inappropriately discriminating against, or slandering the honor or credibility of the Service Provider or a third party.

• Infringing upon the property of the Service Provider or a third party, or acts that pose a risk of doing so.

• Causing economic damage to the Service Provider or a third party.

• Engaging in threatening acts against the Service Provider or a third party.

• Using or inducing computer viruses or harmful programs.

• Putting excessive stress on the infrastructure equipment for the Service.

• Attacking the Service Provider's servers, systems, or security.

• Attempting to access the Service Provider's services by a method other than the interface provided by the Service Provider.

• Obtaining multiple User IDs as a single user.

• In addition to the above, any acts that the Service Provider determines to be inappropriate.

• The Service Provider shall not be liable for any damages resulting from changes, interruptions, or termination of the contents of the Service.

• The Service Provider shall not be involved in, nor have any responsibility for, the User's usage environment for the Service.

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE PROVIDER EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The Service Provider does not guarantee that the Service will conform to the specific purpose of the User, that it has the expected functions, commercial value, accuracy, or usefulness, that the User's use of the Service conforms to the laws or internal rules of industry groups applicable to the User, or that defects will not occur.

• The Service Provider does not guarantee that the Service corresponds to all information terminals, and the User acknowledges in advance that defects in the operation of the Service may occur due to OS version upgrades, etc. of the information terminal used for the Service. The Service Provider does not guarantee that such defects will be resolved by program modifications, etc. performed by the Service Provider in the event such defects occur.

• The User acknowledges in advance that the use of part or all of the Service may be restricted due to changes in the terms of use and operational policies of service stores such as the AppStore and Google Play.

• The Service Provider shall bear no liability for compensation for damages incurred directly or indirectly by the User as a result of using the Service.

• The Service Provider shall bear no liability for any damages (including indirect damages and lost profits), loss of opportunity, or business interruption incurred by the User or other third parties, even if the Service Provider has been notified in advance of the possibility of such damages.

• The provisions from Paragraph 1 to the preceding paragraph shall not apply in the event of gross negligence or intentional misconduct by the Service Provider, or when the contract corresponds to a consumer under the Consumer Contract Act.

• Even when the preceding paragraph applies, the Service Provider shall bear no liability to compensate for damages arising from special circumstances among the damages incurred by the User due to acts of negligence (excluding gross negligence).

• When the Service Provider is liable for damages concerning the use of the Service, the Service Provider shall bear liability up to the usage amount received from the User in the month the damage occurred.

• The Service Provider shall bear no responsibility at all for disputes and troubles between the User and other Users. Even if a trouble occurs between a User and another User, it shall be resolved by the responsibility of both parties, and no claims shall be made against the Service Provider.

• If the User causes damage to another User or a dispute arises with a third party in relation to the use of the Service, the User shall compensate for such damage or resolve such dispute at their own expense and responsibility, and shall not cause any inconvenience or damage to the Service Provider.

• If a claim for damages, etc. is made by a third party against the Service Provider due to the User's actions, the User shall resolve this at their own expense (including attorney fees) and responsibility. If the Service Provider pays damages to the said third party, the User shall pay the Service Provider all expenses including such damages (including attorney fees and lost profits).

• If the User causes damage to the Service Provider in relation to the use of the Service, the User shall compensate the Service Provider for the damage (including litigation costs and attorney fees) at their own expense and responsibility.

• Unless previously consented to in writing by the Service Provider, the User shall not assign to a third party their position under these Terms or all or part of their rights or obligations based on these Terms.

• The Service Provider may transfer all or part of the Service to a third party at the Service Provider's discretion, in which case all rights of the User pertaining to the Service, including the User's account within the scope of the transferred rights, shall be transferred to the transferee.

• These Terms shall be governed by and construed in accordance with the laws of Japan.

• Any disputes arising out of or in connection with these Terms, including discussions and litigation between the Service Provider and the User, etc., shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court, depending on the amount sued for.

• Effective from March 11, 2026
